A few weeks later, during heavy rain, a <strong>latent defect<\/strong> seems to emerge: <strong>water infiltration<\/strong> appears in the basement. However, the seller had indeed declared an infiltration before the sale\u2026 and had it &#8220;repaired&#8221; a few weeks before the transaction. So, is it still a latent defect? Can the buyer claim an amount, demand work, or even sue?    <\/p>\n\n<p>The short answer lies in a nuance: a <strong>declared<\/strong> problem is, in principle, no longer &#8220;latent.&#8221; However, everything depends on what was actually declared, the quality of the repair, and the true severity of the defect. Indeed, when a repair fails and the problem returns more severely than what the buyer believed they were purchasing, a recourse may exist, notably thanks to the <strong>legal warranty of quality<\/strong> provided for in the Civil Code of Quebec.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-reponse-rapide\">Quick response<\/h2>\n\n<p>A <strong>declared<\/strong> water infiltration is generally not a latent defect, since the buyer was aware of its existence. However, if the seller claimed that the problem was <strong>resolved<\/strong> and the repair proves to be inadequate\u2014the water returns, the defect is more serious than presented\u2014the buyer may then have a recourse. The legal warranty of quality (Article 1726 of the Civil Code of Quebec) applies automatically to every sale, even without a broker on the seller&#8217;s side. The seller tells you: &#8220;There was a small engine problem, but I had it repaired at the garage.&#8221; So you buy with confidence. Two weeks later, the engine fails: the &#8220;repair&#8221; had fixed nothing.  <\/p>\n\n<p>You hadn&#8217;t bought &#8220;a car with an engine problem.&#8221; You had bought <strong>a car whose problem was supposed to be corrected<\/strong>. That is exactly the issue here.  <\/p>\n\n<p>The seller did not hide the infiltration: she declared it. Nevertheless, she also suggested that it was <strong>resolved<\/strong>. If the water returns, the real question becomes: was the repair botched, and was the true defect\u2014the one still causing water\u2014itself hidden?  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-1-comprendre-la-garantie-legale-au-quebec\">1. Understanding the legal warranty in Quebec<\/h2>\n\n<p>When you buy a property in Quebec, a protection is <strong>automatically<\/strong> activated, without you having to negotiate it: the <strong>legal warranty of quality<\/strong>.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>Simple definition:<\/strong> the legal warranty of quality is the promise provided by law (Article 1726 of the Civil Code of Quebec) that the property sold is free of latent defects that make it unfit for its use, or that diminish its usefulness so much that the buyer would not have bought it, or would have paid less for it.<\/p>\n<\/blockquote>\n\n<p>Furthermore, this warranty exists for <strong>all<\/strong> residential sales: single-family homes, condos, plexes. It protects the buyer against serious bad surprises that already existed at the time of purchase but that they could not see. Selling &#8220;between individuals&#8221; therefore does not make the seller&#8217;s legal obligations disappear. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-2-vice-cache-et-infiltration-d-eau-les-4-criteres-expliques-simplement\">2. Latent defects and water infiltration: the 4 criteria, explained simply<\/h2>\n\n<p>For a problem to be recognized as a <strong>latent defect<\/strong> in Quebec, the buyer must demonstrate four elements. This is the analysis grid used by all courts. <\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>The defect is serious.<\/strong>  It makes the property unfit for its use, or seriously diminishes its usefulness. A basement that takes on water during every heavy rain can clearly be serious. <\/li>\n\n\n\n<li><strong>The defect is latent (not apparent).<\/strong>  A prudent and diligent buyer could not see it during a normal examination. If an expert was needed to detect it, that is a good indication that it was latent. <\/li>\n\n\n\n<li><strong>The defect predates the sale.<\/strong>  The problem already existed\u2014at least in its cause\u2014at the time of purchase.<\/li>\n\n\n\n<li><strong>The defect was unknown to the buyer.<\/strong>  The buyer did not know about it and had not been informed of it.<\/li>\n<\/ol>\n\n<p>Concretely, an invisible foundation crack, hidden behind a finished wall in the basement, that lets water in during every heavy rain, often checks these four boxes.<\/p>\n\n<p>It is criterion No. 4\u2014&#8221;unknown to the buyer&#8221;\u2014that makes our buyer&#8217;s case more delicate, since she <strong>knew<\/strong> there had already been water infiltration. But that is not the end of the story, far from it. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-3-le-coeur-du-probleme-un-defaut-declare-et-repare\">3. The heart of the problem: a declared and &#8220;repaired&#8221; defect<\/h2>\n\n<p>The general rule is logical. By honestly declaring a problem, the seller removes the buyer&#8217;s ability to invoke a <em>latent<\/em> defect for that specific problem. What has been declared cannot, by definition, be &#8220;latent.&#8221;  <\/p>\n\n<p>So, if the seller wrote &#8220;there has already been an infiltration in the basement,&#8221; the buyer cannot plead that she was completely unaware of the risk. <strong>However<\/strong>, three things must be looked at very closely.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-a-qu-est-ce-qui-a-exactement-ete-declare\">a) What exactly was declared?<\/h3>\n\n<p>A vague declaration (&#8220;a small infiltration, now resolved&#8221;) is not equivalent to disclosing a major and recurring structural problem. Thus, if the true defect is much more serious than what was declared, the &#8220;latent&#8221; part\u2014its true extent\u2014can still open a recourse. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-b-la-reparation-etait-elle-reelle-et-adequate\">b) Was the repair real and adequate?<\/h3>\n\n<p>By claiming that the problem was <strong>corrected<\/strong>, the seller created an expectation: a dry basement. A cosmetic repair that masks a defect without fixing it can even <strong>aggravate<\/strong> the seller&#8217;s liability.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-c-la-declaration-etait-elle-exacte-et-de-bonne-foi\">c) Was the declaration accurate and in good faith?<\/h3>\n\n<p>A seller who minimizes or distorts reality (&#8220;it was just once&#8221;) may be committing a <strong>misrepresentation<\/strong>. This is evidence of <strong>bad faith<\/strong>, which considerably strengthens the buyer&#8217;s case and can lead to additional damages. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>In short:<\/strong> the fact that the seller declared the water infiltration does not close the door; it moves it. The question then becomes: did the buyer purchase a house &#8220;with a known and truly resolved problem,&#8221; or &#8220;with a problem presented as resolved, but whose real and serious cause was still there and latent&#8221;? An individual seller therefore has the same disclosure obligations and the same liability for latent defects. <\/p>\n\n<p>Here, one element is even <strong>favorable<\/strong> to the buyer: <strong>she<\/strong> was represented by a broker, thanks to her buyer brokerage contract.
